These terms apply to Pacing, a production toolkit for iPad, and this website. By using Pacing, you agree to use it responsibly and only with scripts, notes, files, and other content you have the right to use.
1. License
Pacing is licensed for use on supported iPad devices for personal or business use. The license is personal, limited, and non-transferable, except where sharing is permitted through Apple distribution features or required by applicable law.
You may not copy, resell, redistribute, sublicense, rent, lease, lend, or reverse engineer the app except where permitted by law.
When Pacing is distributed through the App Store, Apple’s standard End User License Agreement and applicable Apple usage rules apply unless a custom license is provided. Apple distribution features such as Family Sharing or volume purchasing may provide additional usage rights under Apple’s applicable terms.
2. Availability
Features, availability, requirements, pricing, and regional access may change over time. Beta access, if offered, may have separate testing terms.
3. Trial and purchases
Pacing may offer eligible users a free trial followed by a lifetime unlock. The trial duration, eligibility, available features, and what happens when it ends will be disclosed in the app before you start it. Any paid unlock requires a separate purchase confirmed through the App Store.
If offered, a lifetime unlock is a one-time purchase for the Pacing features described at the time of purchase, for the Apple Account used to complete it. Restoration of an eligible previous purchase is subject to successful verification.
Prices and currencies are provided by the App Store and may vary by country or region. The price displayed by the App Store at the time of purchase applies.
App Store purchases are processed by Apple. Refunds, billing, purchase eligibility, and transaction processing are subject to Apple’s applicable policies and terms. You can request a refund from Apple; eligibility varies by country or region and applicable consumer law.
4. Your production content
You are responsible for the scripts, slate fields, cue text, drawings, take logs, notes, imported files, exports, and other content you use with Pacing. You should only add content that you are allowed to use.
5. Network time and reference tools
Network Time Calibration depends on Google Public NTP, system settings, and network availability. It can be turned off in Pacing Settings. Pacing is independent and is not affiliated with Apple Inc.
Sync and Time of Day are visual timing references, not replacements for genlock or hardware timecode. Tools provide visual reference patterns, not calibrated measurement equipment or a calibrated reference monitor. Slate sounds are audible cues, not hardware synchronization signals. Results depend on the iPad, display, camera, sound, and system settings; check critical production requirements with appropriate equipment.
6. Local data and backups
Pacing is designed with local-first behavior for production content and app data. You are responsible for your device, your backups, and any scripts, notes, take logs, or exports you want to keep. Automatic log clearing, if enabled, permanently removes older local entries; export anything you want to retain first.
7. Changes
Pacing may change over time as features are added, removed, improved, or limited. Updates may also change availability, trial access, purchase options, or system requirements.
8. No guarantee
Pacing is provided as-is to the maximum extent permitted by law. No software can guarantee uninterrupted operation, precise synchronization with external equipment, or compatibility with every file, device, or service state.
9. Limitation of liability
To the maximum extent permitted by law, Pacing and its developer are not liable for indirect, incidental, special, consequential, or lost-data damages arising from use of the app.
